CONCERNING
AMENDMENT TO REGULATION OF THE MINISTER OF TRADE NO. 06/M-DAG/PER/1/2007
ON TECHNICAL VERIFICATION OR INQUIRY INTO THE IMPORT OF CERAMICS

THE MINISTER OF TRADE,

Considering:

• a. that in the framework of enhancing effectiveness in the implementation of policies on enforcement of the obligation to verify and inquire technically the import of ceramics and observing the influence of the activity on growth of certain industries; it is deemed necessary to excluded several kinds of ceramics from the technical verification and inquiry;
• b. that in connection to the matter as intended in paragraph a, it is necessary to amend provisions on technical verification and inquiry into the import of ceramics as regulated in Regulation of the Minister of Trade No. 06/M-DAG/PER/1/2007 concerning Technical Verification or Inquiry into the Import of Ceramics;
• c. that based on the considerations as meant in paragraphs a, b and c, it is necessary to stipulate a regulation of the Minister of Trade;

In view of:

• 1. Minister of Trade Regulation No. 06/M-DAG/PER/1/2007 concerning Technical Verification or Inquiry into the Import of Ceramics;
• 2. Minister of Trade Decree No. 18/M-DAG/KEP/1/2007 concerning Stipulation of Surveyors as Technical Verifiers or Inquirers of the Import of Ceramics.

HAS DECIDED:

To stipulate:

MINISTER OF TRADE REGULATION ON THE AMENDMENT TO MINISTER OF TRADE REGULATION No. 06/M-DAG/PER/1/2007 CONCERNING TECHNICAL VERIFICATION OR INQUIRY INTO THE IMPORT OF CERAMICS

Article I

Several provisions in Regulation of the Minister of Trade No. 06/M-DAG/PER/1/2007 are amended as follows:

1. The provision in Article 2 is amended to be read as follows:

"Article 2

(1) The import of ceramics as intended in Article 1 paragraph 2 is subject to verification before the loading.

(2) The provision as intended in paragraph (1) does not apply to ceramics coming into the classification with the tariff headings as follows:

• a. Tariff Heading/HS 69.02: Refractory bricks, blocks, tiles and similar refractory ceramic constructional goods other than those of siliceous fossil meals of similar siliceous earths, namely:
• - Tariff Heading/HS 6902.10.00.00: Containing by weight, singly or together more than 50% of Mg, Ca or Cr expressed as MgO, CaO or Cr203.
• - Tariff Heading/HS 6902.20.00.00: Containing by weight more than 50% of Alumina (A1203, of silica (Si02) or of a mixture or compound of these products.
• - Tariff Heading/HS 6902.90.00: Others
• b. Tariff Heading/HS 69.03: Other refractory ceramic goods (for example: retorts, crucibles, muffles, nozzles, plugs, supports, cupels, tubes, pipes, sheaths, and rods), other than those of silicieous f6ssil meals or similar silicieous earths.
• - Tariff Heading/HS 69003.1O.00.00 : Containing by weight more than 50% of graphite or other forms of carbon or of a mixture of these products
• - Tariff Heading/HS 6903.20.00.00 : Containing by weight more than 50% of alumina (AI203) or of a mixture or compound of alumina and of silica (Si02).
• c. Tariff Heading/HS 6905.90.10.00: Layer bricks for milling in the form of ball.
• d. Tariff Heading/HS 6909.12.00.00 : Goods having hardness equivalent to nine or more in the Mohs scale."

2. The provision in Article 5 is amended to be read as follows:

"Article 5

(1) Ceramics can be imported without technical verification or inquiry in case of the goods:

• a. being needed for technology research and development;
• b. being gifts and/or samples sent through courier service by using aircraft; or
• c. personal moving cargo.

(2) The goods as intended in paragraph (1) cannot be traded."

Article II

The regulation comes into force 30 (thirty) days as from the date of stipulation.

For Public cognizance, the regulation shall be published in State Gazette of the Republic of Indonesia.
